Significant Reduction to Sentence on Appeal

Lorena Lowen

13 March 2024

Our client pleaded guilty to three counts of sexual assault on vulnerable women on the London transport system. He was sentenced at Inner London Crown Court on 25th January 2024.

At sentencing, the Court accepted our submissions as to the category of the offences, and also accepted that the defendant should receive twenty per cent credit. Nevertheless, the Judge sentenced our client to a total of sixty-eight weeks for the three offences.

We appealed the sentence, and the case was heard before the Court of Appeal on 7th March 2024. At that hearing the Court found that the previous sentences had been manifestly excessive. The three sentences were quashed and substituted with three sentences of eleven, twelve, and twelve weeks respectively. This reduced the total sentence from sixty-eight weeks to thirty-five weeks, almost halving the original sentence.

Lorena Lowen acted on this case, assisted by Hugo Cheema-Grubb. We instructed Tom Edwards of Mountford Chambers for both the sentence and the appeal.
