Not guilty of driving with excess alcohol

Our client stood trial at Maidstone Magistrates’ Court on the 22nd of January 2025 having been accused of driving a motor vehicle when the proportion of alcohol in his breath exceeded the prescribed limit.
He was alleged to be found with 63 micrograms of alcohol in 100 milliliters of breath. The limit in England and Wales is 35 micrograms of alcohol in 100 milliliters of breath.
Daniel Cavaglieri represented our client at trial. He argued that there was insufficient evidence upon which our client could be convicted. Whilst the District Judge did conclude there was a case to answer, he agreed that he could not be sure our client was the driver of the motor vehicle.
Our client was found not guilty, and a Defendant’s Costs Order was made for his legal costs.
