Extradition Request to Poland Withdrawn

Sonn Macmillan Walker represented our client in extradition proceedings against Poland. The decision on which the Arrest Warrant was based was an aggregate sentence of 2 years and 4 months, of which 4 months and 29 days remained to be served. The sentence related to four offences.
Our client, the Requested Person, was extradited to Poland in 2012 in respect of three of the same offences for which the current Warrant was issued. The Requested Person had already been discharged on dual criminality grounds by the High Court in relation to the fourth offence.
A number of bars to our client’s extradition were raised, including that extradition would amount to an abuse of process. The Polish authorities have revoked the Arrest Warrant issued with respect to our client, who was subsequently discharged by the District Judge.
