Extradition Request to Lithuania Discharged

Sonn Macmillan Walker represented our client, KM, in extradition proceedings against Lithuania where KM was wanted to serve an aggregate sentence of 1 year 10 months’ imprisonment in relation to a totality of eight offences. A number of bars were raised against our client’s extradition, including that extradition would be incompatible with the right to a private and family life pursuant to Article 8 of the European Convention of Human Rights.
It was argued that, in the event of KM’s extradition, her young son T would have likely suffered severe if not devastating harm, resulting in significant impact on his psychological wellbeing and development.
On 13 November 2024, District Judge Curtis handed down judgment in this case and our client was discharged pursuant to Article 8 of the European Convention of Human Rights. The Judge accepted that KM’s extradition would have a dreadful impact on T. The Lithuanian Judicial Authority have confirmed that they will not appeal the decision.
