DWP Offers Out of Court Penalty After Representations

Our client faced prosecution for making dishonest representations to obtain housing benefit, contrary to section 111A(1A) and (3) of the Social Security Administration Act 1992. An initial overpayment figure of £22,379 was alleged before the overpayment was reduced to £7,718.03 by the London Borough of Waltham Forest.

A request for an urgent review and written representations were made on our client’s behalf, submitting that it wasn’t in the public interest to purse to the prosecution. In response to those, the DWP offered our client an Out of Court Penalty (Administrative Penalty).

Our client was incredibly appreciative of her solicitor and expressed how relieved she felt after this outcome.
